Terms & Conditions

All contracts are governed by English law and jurisdiction.

It is illegal to sell alcoholic beverages to anyone under the age of 18 in the UK.

We shall not be liable for failure to meet agreed obligations due to circumstances beyond our control.

Prices

All prices are in UK Pounds Sterling and include UK Excise Duty and VAT, unless the wine is marked as ‘En Primeur’ (q.v., below), in which case the price is quoted in UK Pounds Sterling without Duty and VAT.

All goods remain the property of Nemo Wine Cellars Ltd until payment has been received in full.

Delivery

Goods will not be despatched until payment has been received in full.

All delivery dates are only estimates and we do not guarantee to meet any fixed delivery date unless specifically agreed.

Goods must be inspected upon delivery and any breakages or shortages must be notified to us within 48 hours of receipt.

If you cannot be available to receive a delivery, you may nominate a neighbour to receive that delivery or ask us to leave it in a safe place.  In such circumstances, this is necessarily at your risk as we can have no control over your nominees or the security of your safe place.

Order cancellations

You may cancel your order (except for ‘En Primeur’ orders) at any time up to 14 days after delivery or, if you requested that we store the wine for you, the date on which the wine is placed into your customer reserve account.

You must notify us in writing either via email or post within the 14 day period stated above.

Should you decide to cancel after we have despatched the wine, the wine must be returned within 14 days of communication of cancellation, at your cost, and in saleable condition.

Once the goods have been returned to us, the cost of the goods purchased will be reimbursed to you in full within 30 days.

Whilst every effort is made to check the provenance and condition of all our mature wines we cannot be held responsible for any wine later found to be out of condition.

Storing wine with us

We are happy to store your wine for you in one of our environmentally controlled warehouse, either at LCB in Burton-on-Trent, or at EHD in Sunbury, near Heathrow Airport.  This facility is referred to as a ‘customer reserve account’.

Wines purchased from Nemo Wine Cellars can be stored free of charge for up to six months after purchase.  After that, or if the wine is not bought from us, storage is charged at £1.25 per 9 litre case (12x75cl bottles, 24×37.5cl bottles, 6x150cl bottles etc.), or part thereof, per calendar month, or part thereof.

If you are storing wine with us, please notify us at [email protected], or by calling us on 020 8191 9671 to instruct us where to deliver the wine to.

If we are storing your wines under bond, you must pay any duties or taxes that apply (at the prevailing rates) and any storage charges that you have incurred, before delivery of the wines.

If you bought your wine from us duty paid, it is likely that you will already have paid a delivery charge for the wine and therefore no more will be due but if you change where you want the wine delivered to, there may be an extra fee at our prevailing delivery rates.  If you bought your wine from us under bond, then it is likely that you did not pre-pay our delivery charge and we will charge for delivery at our prevailing rates.

We reserve the right to alter our storage fees with six calendar months notice.

We reserve the right to terminate our storage agreement with you with 30 days notice if your account is in arrears by more than 30 days, or with one calendar year’s notice.

If you decide that you would like us to sell wines that were purchased from us and then stored in your customer reserves account, please notify us at [email protected] and once we have agreed a sale price with you, we will offer them for sale on our retail site.  In such circumstances, we charge a commission of 10% of the agreed sale price.

If your account with us is in arrears by more than six months, we reserve the right to re-list your stock for retail sale in order to offset your payment arrears.

En Primeur purchases

If you purchase a wine ‘en primeur’, you must pay for the wine, as normal, on receipt of our Pro-Forma invoice.

If you wish to request en primeur wines to be bottled in other than 75cl bottles, please contact us at [email protected] before ordering.

The ‘En Primeur price’ covers only the price of the wine, and its transportation under bond to one of our warehouses.  Legal and beneficial title to the wine only passes to you when the wine arrives at our warehouse (as title is not transferred to us until then).

Once the wine arrives at our warehouse, it will be stored in your name according to the conditions shown above (‘Storing your wine with us’) and any additional fees, duties and taxes must be paid before delivery to you, as per those conditions.
